| dc.description.abstract | يتميز التعاقد الإلكتروني بكون المستهلك الإلكتروني غالبًا جاهلا بمحل التعاقد، لذا تم إقرار الالتزام بالإعلام الإلكتروني حتى يتم تكريس الأمن التعاقدي في العلاقة التعاقدية الإلكترونية، وهو منطلق هذه الدراسة الهادفة لتسليط الضوء على إحدى الآليات التي تسمح بتفعيل الأمن التعاقدي والمتمثلة في الإعلام الإلكتروني باعتباره التزاما يسبق التعاقد الإلكتروني، ويقع على عاتق التاجر الإلكتروني من خلال إعلام المستهلك الإلكتروني بكافة المعلومات والبيانات الجوهرية. وهذه الآلية كُرست تدعيما للمركز القانوني للمستهلك إذ أن اعتباره الطرف الأضعف في المعادلة التعاقدية، يجعل من الضروري توفير السبل الحمائية له، وهو ما يسمح بتدعيم الثقة في التعامل الإلكتروني مما يسمح بتعميمه وجعله خيارا استراتيجيا للاقتصاد الوطني..
