Abstract
تتناول المذكرة الطعون القضائية على القرارات التأديبية في الوظيفة العمومية الجزائرية، مع التركيز على دورها في ضمان مشروعية الإجراءات الإدارية وحماية حقوق الموظفين. وتُحلل المذكرة الأسس النظرية للقرارات التأديبية، بما في ذلك تعريفها وخصائصها وأنواعها والضمانات المُقدمة للموظفين، إلى جانب مفهوم الطعون القضائية وأهميتها في تعزيز الشفافية. كما تستعرض الإجراءات العملية، كالجهات القضائية المختصة، وشروط رفع الدعوى، ومراحل التقاضي، بالاعتماد على القانون 08-09، بصيغته المعدلة بالقانون 22-13، والمرسوم 06-03. تُسلّط الدراسة الضوء على التحديات، مثل تعقيد النصوص القانونية، وضعف لجان الاستئناف الإدارية، وندرة السوابق القضائية، وتقترح حلولاً مثل تبسيط الإجراءات، وتعزيز الوعي القانوني، وتوحيد تطبيق الأحكام لتحقيق التوازن بين السلطة الإدارية وحقوق الموظفين، بالاعتماد على الدراسات السابقة التي تناولت الرقابة القضائية والطعون التأديبية.This memorandum addresses judicial appeals against disciplinary decisions in the Algerian civil service, focusing on their role in ensuring the legitimacy of administrative procedures and protecting employee rights. The memorandum analyzes the theoretical foundations of disciplinary decisions, including their definition, characteristics, types, and guarantees provided to employees, as well as the concept of judicial appeals and their importance in promoting transparency. It also reviews practical procedures, such as the competent judicial authorities, the conditions for filing a lawsuit, and the stages of litigation, based on Law 08-09, as amended by Law 22-13, and Decree 06-03. The study highlights challenges, such as the complexity of legal texts, the weakness of administrative appeals committees, and the scarcity of judicial precedents. It proposes solutions, such as simplifying procedures, enhancing legal awareness, and unifying the application of provisions to achieve a balance between administrative authority and employee rights, drawing on previous studies on judicial oversight and disciplinary appeals.
