Abstract
تناولت هذه الدراسة مسألة الحصانة القضائية الجنائية للمبعوث الدبلوماسي، والتي تمثل ضمانة أساسية لاستقلال المبعوث وقدرته على أداء مهامه على أكمل وجه وفقًا لمقتضيات حسن سير العلاقات الدولية. انطلقت الدراسة من معالجة نظرية تم فيها تحليل الإطار المفاهيمي للحصانة. ثم انتقلت إلى دراسة الجوانب التطبيقية في إطار الممارسة الدولية، وكشف التحديات الواقعية الناجمة عن إساءة استخدام الحصانة ضد الجرائم الجسيمة. أظهرت الدراسة وجود تناقض بين القواعد القانونية المعمول بها والممارسات الفعلية للدول، مما أثار جدلاً فقهيًا حول مدى استمرار مشروعية الحصانة المطلقة في ظل تنامي التحديات الأمنية والقيم العالمية لحقوق الإنسان. كما خلصت الدراسة إلى أن الحصانة لا ينبغي أن تكون وسيلة للإفلات من العقاب، بل ينبغي تقييدها عند الضرورة تحقيقًا للتوازن بين مبدأ السيادة الوظيفية ومقتضيات العدالة.This study addressed the issue of the criminal judicial immunity of the diplomatic envoy, which represents a basic guarantee of the envoy’s independence and his ability to perform tasks to the fullest extent in accordance with the requirements of the proper functioning of international relations. It started from a theoretical treatment in which the conceptual framework of immunity was analysed. The study then moved to examining the applied aspects within the framework of international practice, and revealing the realistic challenges resulting from the abuse of immunity against serious crimes. The study showed a discrepancy between the established legal rules and the actual practices of states. Which resulted in a jurisprudential debate about the extent of the continued legitimacy of absolute immunity in light of the growing security challenges and the universal values of human rights. The study also concluded that immunity should not be a means of escaping punishment, but rather it should be restricted when necessary in order to achieve a balance between the principle of functional sovereignty and the requirements of justice.
