Abstract
يتناول هذا البحث المحكمة الإدارية الاستئنافية في الجزائر من خلال تحليل إطارها المفاهيمي والقانوني، وتسليط الضوء على تطور القضاء الإداري الاستئنافي، لا سيما في أعقاب التعديل الدستوري الأخير. كما يدرس البحث الأسس الدستورية والقانونية لهذه المحاكم، ويحلل اختصاصاتها وتنظيمها الداخلي وإجراءات الطعن أمامها.
وتخلص الدراسة إلى أن إنشاء المحاكم الإدارية الاستئنافية يعزز مبدأ التقاضي على درجتين ويدعم حماية الحقوق والحريات في المنازعات الإدارية؛ غير أن فاعلية هذه المحاكم تظل رهناً بالتطبيق السليم للنصوص القانونية وتوفر الموارد اللازمة.This research examines the Administrative Court of Appeal in Algeria by analyzing its conceptual and legal framework and highlighting the evolution of appellate administrative justice, particularly following the recent constitutional amendment. It also explores the constitutional and legal foundations of these courts, analyzing their jurisdiction, internal organization, and the procedures for challenging decisions before them.
The study concludes that the establishment of administrative courts of appeal reinforces the principle of two-tier litigation and supports the protection of rights and freedoms in administrative disputes; however, the effectiveness of these courts remains contingent upon the proper application of legal provisions and the availability of necessary resources.
