| dc.description.abstract | استحدث التعديل الدستوري 2016 الهيئة العليا المستقلة لمراقبة الانتخابات التي تعتبر تتويجا لتجربة طويلة للجزائر في مجال تنظيم الانتخابات ومراقبتها، وكذا الاستجابة للمقترحات البناءة التي عبرت عنها العديد من فعاليات المجتمع بمناسبة جولات المشاورات المنظمة في إطار الإصلاحات السياسية. تم تنظيمها بالقانون العضوي رقم : 16/11 ،الذي يهدف إلى تجسيد مبادئ الدستور المتعلقة بالشفافية ومصداقية الانتخابات وتكريس دولة القانون . تعالج هذه المقالة العلمية مضمون القانون العضوي رقم:16/11 من خلال التركيز على طبيعة الهيئة العليا المستقلة لمراقبة الانتخابات وتشكيلها ،اختصاصاتها وتنظيمها وسير عملها ،وما مدى استقلالها الوظيفي وتأثير ذلك على عملها الرقابي ، للكشف عن أهميتها ودورها المنتظر في تعزيز دولة القانون وتدعيم الحقوق والحريات الفردية والجماعية ،لنخلص إلى نتيجة هامة وأساسية هي أن قيام الهيئة العليا بالوظيفة الرقابية غير كاف ،لهذا يجب على المؤسس الدستوري أن يعترف لها أيضا بسلطة الإشراف على الانتخابات في الجزائر . The revision of the constitution of March 7, 2016 institutionalized the high independent body for monitoring the elections. This body was created at the request of the opposition parties in order to ensure the transparency and credibility of the elections. Organic Law No. 11-16 clarified the formation, organization, functioning and functions of this supervisory body. Theoretically, this institution comes to strengthen the State of rights; individual and collective rights and freedoms. we were able to reach the following conclusion: the role of the high independent authority in monitoring elections is very limited, and the constituent must also grant this authority the organization of elections in Algerian.
