| dc.description.abstract | عرفت العقوبة السالبة للحرية قصيرة المدة انتشارا ملحوظا منذ نشأتها في أواخر القرن الثامن عشر حيث شكلت بديلا عن العقوبات البدنية القاسية وأسهمت في ارساء توجه عقابي أكثر إنسانية غير أن التوسع في تطبيقها أبرز حدود فعاليتها خاصة من حيث تأثيرها السلبي على فرص اصلاح المحكوم عليهم وإعادة ادماجهم. كما اتجهت السياسية الجنائية الحديثة إلى تبني بدائل عقابية أكثر ملائمة تطبق وفق ظروف الجريمة وشخصية الجاني بهدف الحد من مساوئ الحبس قصير المدة وقد كرست العديد من التشريعات هذه البدائل وسار المشرع الجزائري في الاتجاه ذاته، من خلال اعتماد بعض النظم البديلة في إطار تعزيز إعادة الادماج الاجتماعي للمحكوم عليهم. Short-termcustodialpunishment has witnessedremarkable expansion sinceitsemergence at the end of the eighteenth century, as itrepresented an alternative to harsh corporal punishments and contributed to establishing a more humane penalapproach. However, the extensive application of thispunishmentrevealed the limits of itseffectiveness, particularlyregarding the rehabilitation and social reintegration of offenders, due to itsnegative social, psychological, and professionaleffects. With the development of modern criminalpolicy, contemporarylegislations have adopted more suitable alternative sanctions that takeintoaccount the nature of the offense and the personality of the offender, with the aim of reducing the negativeeffects of short-termimprisonment and achievingrehabilitation and reintegration objectives. The Algerian legislator has followedthis trend by introducingseveral alternative sanctions that promote the social reintegration of convictedpersons. | |
