| dc.description.abstract | يعد السبب من أهم أركان القرار الإداري، إذ يمكن اعتبار القرار الإداري مشروعا وصحيحا إلا إذا استند إلى أسباب واقعية أو قانونية صحيحة تبرره وتشكل الدافع لاتخاذه. بالرغم من أن الإدارة تتمتع بسلطة تقديرية في اختيار أسباب قراراتها ، إلا أن هذه السلطة ليست مطلقة بل تخضع لرقابة قضائية تهدف إلى تحقيق ما تناولناه وهو بالدراسة في مذكرتنا هذه من مشروعية هذه الأسباب حماية الأفراد من تعسف الإدارة.The cause is considered one of the most important elements of the administrative decision, as the administrative decision can only be deemed legal and valid if it is based on correct factual or legal reasons that justify it and constitute the motivation for taking it. Although the administration enjoys discretionary power in choosing the reasons for its decisions, this power is not absolute but is subject to judicial oversight, which aims to ensure what we addressed in this memorandum the legality of these reasons in order to protect individuals from administrative abuse. | |
