| dc.description.abstract | أصبحت الأخبار الكاذبة إحدى مصادر التهديد للأمن العمومي ، وغالبا ما تستهدف إثارة الخوف والفزع وإضطراب المجتمع بفئاته المختلفة، خاصة إذا إستهدفت موضوعات حيوية تهم المواطنين، أو إذا تطرقت إلى قضايا ترتبط بالأمن العمومي وإستقرار النظام العام ، كالأزمات والكوارث، و من أجل حماية المجتمع من أثر الأخبار الكاذبة والمغرضة، كان منطقيا أن يتدخل المشرع الجزائي الجزائري لمحاربة هذه الظاهرة، التي تشكل خطورة بالغة على أمن المجتمع وسلامته وعلى النظام العام، لذلك لابد من دراسة موضوع جريمة نشر الأخبار الكاذبة وأثرها من مختلف الجوانب ومنها القانوني نظرا، لما يترتب على تلك الأخبار أو الأنباء من مساس بالنظام والأمن العموميين،وعليه تهدف هذه الورقة البحثية الى التعرف على جريمة نشر الأخبار الكاذبة في قانون العقوبات الجزائري. fake news has become one of the sources of threat to public security, and it is often aimed to provoke fear, panic and disturbance in the different categories of society, especially if it targets vital issues of interest to citizens, or if it addresses issues related to public security and stability of public order, such as crises and disasters, and in order to protect society from the impact of fake and malicious news, it was logical for the Algerian penal legislator to intervene to fight this phenomenon, which poses a grave danger to the security and safety of society and to public order. Therefore, the subject of the crime of spreading false news and its impact from various aspects, including the legal one, must be studied in view of the consequences of that news. Whoever violates public order and security, Accordingly this research paper aims to identify the crime of spreading fake news in the Algerian penal code. | |
