Abstract
تتناول هذه الدراسة الجرائم المرتكبة ضد أمن الدولة في القانون الجزائري، مُميزةً بين الجرائم التي تُهدد الأمن الداخلي - كالإرهاب والتآمر - وتلك التي تُؤثر على الأمن الخارجي - كالخيانة والتجسس. وتُحلل العناصر القانونية لكل جريمة، وتستعرض التدابير الموضوعية والإجرائية المُتخذة لمقاضاتها. وتخلص الدراسة إلى أن الإطار القانوني الجزائري يُوفر نهجًا شاملًا نسبيًا لتجريم هذه الأفعال، وإن كان لا يزال يُعاني من بعض النواقص، بما في ذلك الغموض التشريعي وصعوبات الإثبات. وتتطلب هذه القضايا مراجعة دورية، وتحديثات قانونية، وتعزيز آليات التنفيذ. الكلمات المفتاحية: أمن الدولة، الإرهاب، التآمر، الخيانة، التجسس، القانون الجزائري، الأمن الداخلي، الأمن الخارجيThis thesis examines crimes against state security under Algerian law, distinguishing between crimes that threaten internal security—such as terrorism and conspiracy—and those that affect external security—such as treason and espionage. It analyzes the legal elements of each crime and reviews the substantive and procedural measures taken to prosecute them. The study concludes that the Algerian legal framework provides a relatively comprehensive approach to criminalizing these acts, although it still suffers from some shortcomings, including legislative ambiguity and evidentiary difficulties. These issues require periodic review, legal updates, and strengthening enforcement mechanisms.
