| dc.description.abstract | الأصل أنه يتعين أن يهدف كل قرار إداري صادر تحقيق المصلحة العامة، كما أنه يتعين أن يحقق الهدف الذي أراده المشرع وألا يخرج عن مقتضاه، وإلا كان معيبا بعيب الانحراف في استعمال السلطة، وهنا تبرز أهمية الرقابة القضائية على أعمال جهة الإدارة بصفة خاصة، لحماية حقوق الأفراد وحرياتهم من انحراف الإدارة في استعمالها لما منحه لها القانون من سلطات، وبالنظر لخصوصية عيب الانحراف بالسلطة باعتباره عيبا خفيا فإن إلغاء القرارات المشوبة به تتسم بخصوصية خاصة. Generally, every issued administrative decision should be aimed to realize the public interest, as it must achieve the legislature desired goal, to go with it and to avoid deviations or it would be defected by the power deviation uses.
