| dc.description.abstract | الــــمـــــلـــخـــــــص تتناول المذكرة موضوع الأمن القانوني في المادة الجزائية في التشريع الجزائري، مسلطة الضوء على أهميته كمبدأ أساسي لضمان حماية الحقوق والحريات، تعزيز الثقة في النظام القضائي، وتقليل النزاعات الجنائية من خلال نصوص واضحة ومستقرة، مع تحليل مبادئه مثل قابلية القانون للتوقع، عدم الرجعية، والمساواة، وتأثيرها في دعم الأمن الاجتماعي، وتبرز التحديات التي تواجه تطبيقه، كتعقيد الصياغة والتضخم القانوني، واقتراح إصلاحات تشريعية وقضائية لتعزيز فعاليته، مستندة إلى النظام القانوني الجزائري ومقارنات دولية، مع التأكيد على دور الأمن القانوني في تحقيق العدالة واستقرار المجتمع. Abstract: The memorandum addresses the concept of legal security in Algerian criminal law, highlighting its significance as a fundamental principle for ensuring the protection of rights and freedoms, enhancing trust in the judicial system, and reducing criminal disputes through clear and stable legal texts. It analyzes its core principles, such as the predictability of the law, non-retroactivity, and equality, and their impact on supporting social security. The memorandum also identifies challenges to its implementation, such as complex drafting and legislative inflation, proposing legislative and judicial reforms to enhance its effectiveness, drawing on the Algerian legal system and international comparisons, while emphasizing the role of legal security in achieving justice and societal stability. | |
