| dc.description.abstract | إن إقرار مبدأ حرية الأسعار من خلال الأمر 03-03 المتعلق بالمنافسة هو إقرار لحرية المنافسة، وهو ما يقتضي ويكرس ضمنا مبدأ حرية التجارة والصناعة. ويمثل هذا المبدأ النظام الليبرالي الحر، بحيث لا يكون لتحديد الأسعار على أساس قواعد المنافسة أي معنى دون الاعتراف بمبدأ الحرية السعرية. إلا أن من أصعب المشاكل التي تواجه الحياة الاقتصادية، سواء في الماضي أو الحاضر، هو اضطراب الأسواق وارتفاع الأسعار وعدم الاستقرار، خاصة بالنسبة للسلع والخدمات الأساسية، وذلك بهدف حماية القدرة الشرائية للمواطن وضبطها واستقرارها. السوق، وتتدخل الدولة في تحديد أسعار هذه السلع والخدمات الضرورية، من خلال اعتماد آليات قانونية تهدف في مجملها إلى تحقيق أهداف اجتماعية واقتصادية للحد أو منع أي تعد على الأسعار الحرة.
