Abstract
تعالج هذه الدراسة ظاهرة العنف الأسري باعتبارها تهديدًا مباشرًا لاستقرار الأسرة وسلامة أفرادها، خاصة في ظل تزايدها داخل المجتمع الجزائري. وتهدف إلى تسليط الضوء على الآليات القانونية التي اعتمدها المشرع الجزائري للوقاية من هذه الجرائم والتصدي لها، سواء عبر التجريم والعقاب، أو من خلال آليات بديلة كـالوساطة والصلح.
تبرز الدراسة دور القضاء والنيابة العامة في هذا السياق، مع تحليل الإطار القانوني المنظم للعلاقات الأسرية، من خلال قوانين العقوبات، الإجراءات الجزائية، والأسرة. وقد تم اعتماد المنهج الوصفي التحليلي، وقُسمت الدراسة إلى فصلين أساسيين: الأول يُعنى بتحديد مفهوم العنف الأسري وأنواعه، والثاني يتناول إجراءات المتابعة والعقوبات المقررة لمكافحته.
خلصت الدراسة إلى أن العنف الأسري سلوك مكتسب تغذيه التنشئة الاجتماعية والضغوط النفسية اليومية، وهو من أخطر الظواهر التي تهدد استقرار الأسرة والمجتمع، كما أن تدخل المشرع الجزائري لتجريمه يمثل خطوة هامة لكنها غير كافية، مما يستوجب تعزيزها بآليات وقائية وقضائية فعالة. This study addresses the phenomenon of domestic violence as a direct threat to the stability of the family and the safety of its members, especially amid its growing prevalence in Algerian society. It aims to shed light on the legal mechanisms adopted by the Algerian legislator to prevent and combat these crimes, whether through criminalization and punishment or alternative mechanisms such as mediation and reconciliation.
The study highlights the role of the judiciary and the public prosecutor in this context, analyzing the legal framework governing family relations through the Penal Code, the Code of Criminal Procedure, and the Family Code. A descriptive and analytical methodology was adopted, and the study was divided into two main chapters: the first focuses on defining domestic violence and its types, while the second examines the follow-up procedures and penalties established to combat it.
The study concluded that domestic violence is a learned behavior fueled by social upbringing and daily psychological pressures. It is among the most dangerous phenomena threatening family and societal stability. While the Algerian legislator’s move to criminalize such acts is an important step, it remains insufficient and must be supported by effective preventive and judicial mechanisms.
