| dc.description.abstract | النظام القانوني للمؤسسة العمومية في الجازئر م ر بمرحلتين أساسيتين: قبل دستور 1989 ، حيث طغى الطابع الإيديولوجي وغياب التأصيل القانوني الدقيق للمؤسسا ت الإدارية والاقتصادية وذات الطابع الخاص، وبعده، بدأت إصلاحات قانونية هامة، أبرزها القانون 88 - 01 لسنة 1988 الذي ح ول المؤسسة الاقتصادية إلى شركة تجارية تخضع للقانون الخاص، وقانون 1989 لحرية الأسعار، ثم الأمر 06 / 95 لسنة 1995 الذي ر سخ مبدأ المنافسة واقتصاد السوق ، نتج عن هذه المرحلة ظهور مؤسسات متنوعة )صناعية، علمية، ثقافية، تربوية (، مما كشف الحاجة إلى تأطير قانوني مو حد يضمن وضو حا وفعالية في تسيير المرفق العام.The legal system of public institutions in Algeria went through two main phases: before the 1989 Constitution, where the ideological nature and the absence of precise legal foundations for administrative, economic and private institutions prevailed. After that, important legal reforms began, most notably Law 88-01 of 1988, which transformed the economic institution into a commercial company subject to private law, and the 1989 Law on Price Freedom, then Order 06/95 of 1995, which established the principle of competition and the market economy. This phase resulted in the emergence of diverse institutions (industrial, scientific, cultural, educational), which revealed the need for a unified legal framework that ensures clarity and effectiveness in the management of the public service. | |
