| dc.description.abstract | تخضع القرارات الإدارية للرقابة القضائية، ويختص القاضي الإداري بدراسة عناصر القرار الإداري الخارجية منها، المتعلقة بشكل القرار الإداري، والداخلية المتعلقة بالموضوع، كما يختص بالتدقيق في عناصر القرار الإداري. مطابقة هذه العناصر لمبدأ الشرعية، مع العلم أن شدة الرقابة تختلف باختلاف نوع الاختصاص الإداري، فهي تشتد عندما يكون الاختصاص الإداري، وتقل في ظل السلطة التقديرية الإدارية، خاصة فيما يتعلق بالمخالفة. لعنصر القطعية، كما أن رقابة القاضي الإداري تتجاوز عنصر السبب إلى فحص مدى توافق وقائع القرار وأسبابه مع القرار. محتوى.
