Abstract
يعتبر تأثير التطور التكنولوجي على اجراءات الحصول على الأدلة أمام المحكمة الجنائية الدولية من أبرز المواضيع التي تثير اشكالات قانونية ، ومن بين أهم هذه الاشكالات هو ما يتعلق بحجية هذه الأدلة، خاصة في الشهادة ،حيث تأخذ الشهادة الحضورية مكانة هامة من بين أدلة الاثبات ،حيث تناقش في مواجهة المتهم ،غيران ما تفرزه التطور التكنولوجي في هذا المجال هو الإدلاء بها باستخدام تكنولوجيات الربط السمعي أو المرئي ،حيث تهدف هذه الدراسة الى تحليل تقنيات الشهادة عن بعد في اطار تبيان حجيتها كوسيلة اثبات أمام المحكمة الجنائية الدولية و خضوعها لمبدأ الاقتناع الشخصي للقاضي وفقا لما جاء في نظام روما الأساسي والقواعد الاجرائية وقواعد الاثبات . The impact of technological development procedure for obtaining evidence before the International Criminal Court is one of the most prominent topics that raises legal problems. in particular with regard to the authenticity of this evidence, and in particular the testimony where the latter takes an important place among the evidence, the witness must be present at the seat of the Tribunal, where it is discussed in the face of the accused. But what technological development has created in area is that it can be made using audio or visual interconnection technologies in exceptional cases, This study aims at analysing the techniques of remote testimony in the context of its authenticity as a means of proof before the International Criminal Court on the one hand and its subjection to the personal conviction of the judge in accordance with the Rome Statute and the Rules of Procedure and Evidence on the other.
