| dc.description.abstract | في ضوء التهديدات التي يتعرض لها الشهود وذويهم من قبل الجناة، بسبب ما يقدمونه للمحكمة من معلومات مهمة الظهار الحقيقة، و قد يدفع هذا الخطر المحدق بهم الى الأحجام عن اداء الشهادة، لذلك اتخذ المشرع الجزائري قرار اضفاء الحماية الجزائيئية على الشهود، ورصدت مجموعة من العقوبات لكل من حاول المساس بهم، فشرع الحماية الجزائية الموضوعية اضافة الى الحماية الجزائية االجرائية والمتمثلة في مجموعة من تدابير الشكلية، والغير اجرائية لضمان سالمتهم دون وقوع اي ضرر عليهم.In light of the threats to which witnesses and their families are exposed by perpetrators, due to the important information they provide to the court to reveal the truth, and this imminent danger may lead them to refrain from giving testimony, the Algerian legislator has therefore taken the decision to provide criminal protection to witnesses, and has allocated a set of penalties for anyone who attempts to harm them. It has legislated substantive criminal protection in addition to procedural criminal protection, which is represented in a set of formal and non-procedural measures to ensure their safety without any harm befalling them. | |
