Abstract
تُعد جريمة التزوير من أخطر الجرائم الواقعة على الثقة العامة، لما لها من أثر مباشر على استقرار المعاملات وحماية الحقوق. فهي لا تقتصر على المساس بالمحررات الرسمية والعرفية، وإنما تمتد آثارها إلى إضعاف الثقة في المؤسسات والهيئات الرسمية. وقد تناولت هذه الدراسة مفهوم جريمة التزوير وتمييزها عن غيرها من الجرائم المشابهة، مع تحليل تطورها التاريخي والقانوني، ثم الوقوف عند الإطار القانوني المنظم لها في التشريع الجزائري. وقد ركز البحث على أركان الجريمة: الركن المادي، الركن المعنوي، والركن الشرعي، مع بيان كيفية قيام المسؤولية الجزائية عن مرتكبي التزوير، سواء كانوا فاعلين أصليين أو شركاء. كما استعرض العقوبات المقررة في قانون العقوبات الجزائري وفق التعديلات الأخيرة، مبرزاً التفرقة بين تزوير المحررات الرسمية والعرفية، إضافة إلى العقوبات التكميلية والتدابير الاحترازية. خلصت الدراسة إلى أن المشرع الجزائري تبنى سياسة جنائية صارمة في مواجهة التزوير لضمان حماية الثقة العامة وتحقيق الردع العام والخاص Forgery is considered one of the most serious crimes against public trust, as it directly affects the stability of transactions and the protection of individual rights. It does not only harm official and private documents but also undermines confidence in public institutions and legal systems. This study examined the concept of forgery and its distinction from similar crimes, analyzed its historical and legal evolution, and explored the legal framework governing it under Algerian law. The research focused on the constitutive elements of the crime: the material element, the moral element, and the legal element. It also highlighted the basis of criminal responsibility for perpetrators of forgery, whether as principal offenders or accomplices. Furthermore, the study reviewed the penalties provided by the Algerian Penal Code, distinguishing between forgery of official and private documents, and examined complementary penalties and precautionary measures. The findings reveal that Algerian legislation adopts a strict criminal policy against forgery in order to safeguard public trust and ensure both general and specific deterrence.
