Abstract
يعتبر مبدأ المشروعية من اهم الركائز التي تقوم دوله القانون على كل من الحاكم والمحكومين والاصل امام مبدا المشروعية في الق ا رر الاداري لا ينفصل عن معنى الرمزي عندما يكون للقانون غير ان هذا المبدأ يحتاج الى شيء من المرونة تأخذ بعين الاعتبار رسالة الادارة العامة ومهامها التي تتلخص في تحقيق صالح العام في قواعد القانونية الا ان الدولة القانونية المشروعية الذي يعتبر اساس لحمايه حقوق الافراد وحريتهم الادارية
The principle of legitimacy is considered one of the most important pillars upon which the rule of law is based, for both the ruler and the ruled. The principle of legitimacy in administrative decisions is inseparable from the symbolic meaning of the law. However, this principle requires some flexibility that takes into account the mission and tasks of public administration, which are summarized in achieving the public interest in the rules of law. However, the legal state is based on legitimacy, which is the foundation for protecting individual rights and administrative freedom.
