Abstract
أدى التطور التشريعي في الجزائري إلى ظهور القانون 08/23 الذي يعد من أبرز النصوص التنظيمية التي سعت إلى ضبط ممارسة حق االإضراب، بما يوازن بين حماية هذا الحق الدستوري وضمان استمرارية الخدمة العمومية، لاسيما في القطاعات الحيوية، وقد تناولت هذه الدراسة موضوع ضو ابط ممارسة حق الإضراب في ظل هذا القانون، وذلك من خلال معالجة الإطار المفاهيمي والقانوني للإضراب، ثم تحليل الجوانب التنظيمية التي جاء بها القانون الجديد.
وقد تبين من خلال الد ارسة أن القانون 08/23 قد وضع جملة من الضوابط والإجراءات لمباشرة الإضراب، كالإشعار المسبق، وموافقة العمال على الإضراب، وعرقلة حرية العمل، بالإضافة إلى تحديد القطاعات التي يمنع فيها الإضراب كليا أو جزئيا وإن تنظيم حق الإضراب في ظل هذا القانون يعكس رغبة المشرع في تكريس التوازن بين حق العمال في الدفاع عن مصالحهم وبين مصلحة المجتمع في استمرار المرافق العموميةThe legislative developments in Algeria led to the emergence of Law 08/23, one of the most prominent regulatory texts seeking to regulate the exercise of the right to strike, balancing the protection of this constitutional right with ensuring the continuity of public service, particularly in vital sectors. This study addresses the controls on the exercise of the right to strike under this law, by examining the conceptual and legal framework of the strike and then analyzing the regulatory aspects contained in the new law.
The study revealed that Law 08/23 established a set of controls and procedures for initiating a strike, such as prior notice, workers' consent to the strike, and obstructing freedom of work. It also identified sectors in which strikes are wholly or partially prohibited. The regulation of the right to strike under this law reflects the legislator's desire to establish a balance between the right of workers to defend their interests and the community's interest in the continuity of public services.
