Abstract
يتناول هذا الموضوع تنظيم القضاء الإداري في الجزائري بموجب القانون العضوي 10-22،
الذي أُدرج ضمن إصلاحات شاملة للمنظومة القضائية. يهدف إلى تعزيز استقلالية القضاء الإداري وتكريس مبدأ التقاضي على درجتين. تطرق الملخص إلى هيكلة الجهات القضائية الإدارية، من المحاكم الإدارية كدرجة أولى، إلى المحاكم الإدارية الاستئناف، مع التركيز على المحكمة الإدارية الاستئنافية بالجزائر العاصمة لما لها من اختصاصات استثنائية. كما أبرز دور مجلس الدولة كجهة عليا تسهر على توحيد الاجتهاد وضمان احتر ام القانون، مع مناقشة بعض التحديات المرتبطة بتوزيع الاختصاصات وأثرها على مبدأ التقاضي درجتين.This topic examines the organization of the administrative judiciary in Algeria under Organic Law 10-22, which was included as part of comprehensive reforms to the judicial system. It aims to strengthen the independence of the administrative judiciary and establish the principle of two-tier litigation. The summary addresses the structure of the administrative judiciary, from the administrative courts as first instance to the administrative courts of appeal, with a focus on the Administrative Court of Appeal of Algiers due to its exceptional jurisdiction. It also highlights the role of the Council of State as a higher authority that ensures the unification of jurisprudence and respect for the law, while discussing some of the challenges associated with the distribution of jurisdictions and their impact on the principle of two-tier litigation.
