Abstract
تهدف هذه الدراسة إلى فهم "دور الصفقات العمومية في تحسين مستوى الدولة وفقا لأحكام القانون 23-12"، وذلك في سياق سعي الدولة الجزائرية لإرساء مبادئ الحوكمة الرشيدة والشفافية وتعزيز التنمية الاقتصادية والاجتماعية من خلال إصلاح منظومة الصفقات العمومية.
حيث تم التطرق إلى الإطار المفاهيمي والقانوني للصفقات العمومية، مع التركيز على تطورها في التشريع الجزائري وقراءة تحليلية لأحكام القانون الجديد 23-12. كما تمتسليط الضوء على الأبعاد الاقتصادية والاجتماعية للصفقات العمومية ودورها في التنمية المحلية وتحقيق الفعالية الإدارية.
من خلال التقييم شامل لمستوى تطبيق القانون الجديد، تم عرض لأهم الإيجابيات التي أتى بها، وكذا التحديات والعراقيل التي ما تزال قائمة، حيث يعد هذا القانون تطورا نوعيا مقارنة بالأنظمة السابقة، إلا أن فعاليته مرهونة بتطبيقه الميداني وتوفر بيئة مؤسساتية داعمة.This study aims to understand "The Role of Public Procurement in Enhancing the State’s Performance According to Law 23-12," within the framework of Algeria’s efforts to establish the principles of good governance and transparency, and to promote economic and social development through the reform of the public procurement system.
The research addressed the conceptual and legal framework of public procurement, with a particular focus on its evolution in Algerian legislation and an analytical reading of the provisions of the new Law 23-12. It also highlighted the economic and social dimensions of public procurement and its role in local development and the achievement of administrative efficiency.
Through a comprehensive assessment of the level of implementation of the new law, the study presented its most significant advantages, as well as the challenges and obstacles that still persist. Although the law represents a qualitative development compared to previous systems, its effectiveness remains dependent on its practical implementation and the availability of a supportive institutional environment.
