Abstract
This work deals with the study and analysis of the issue of monitoring the electoral process in light of Ordinance 21-01 containing the organic law related to the electoral system, by highlighting the forms of oversight guaranteed by the Algerian legislator through the various stages of the electoral process, focusing on the new qualitative guarantees and assessing their effectiveness in achieving the integrity and credibility of the electoral process The most important of these guarantees is the constitution of the Independent National Electoral Authority, in accordance with the constitutional amendment of 2020, as one of the institutions for monitoring the electoral process.
As for the most important forms of oversight approved by the Algerian legislator on the elections, we discussed in this study the administrative and judicial oversight at the level of all stages of the electoral process, represented in the preparatory processes for the electoral process from preparing and reviewing electoral lists and then running for office in the first chapter, in addition to the voting stage and what follows. From the later stages of counting the votes,
focusing on the results and announcing them, as well as the appeals related to them in a second chapter, and we concluded at the conclusion of this study that the Algerian legislator succeeded by adopting the new amendments included in Ordinance 21-01 in providing the necessary legal protection to ensure the integrity and transparency of the electoral process, contrary to what happened It is customary in the elections that took place under previous electoral systems, which
is evidence of the effectiveness of the various forms of control included in Ordinance 21-01. However, this effectiveness remains relative in view of the low participation rates that were recorded in the elections, which remain a real concern for the Algerian legislator, who still has a lot of work to do in order to restore the voter's confidence in the electoral process and those in charge of it, by finding appropriate solutions to correct the imbalances that may The electoral process is marred and an end to the abuses that may hinder it and impair its integrity.
يتناول هذا العمل دراسة وتحليل موضوع مراقبة العملية الانتخابية في ضوء المرسوم 21-01 المتضمن القانون العضوي المتعلق بالنظام الانتخابي، وذلك من خلال تسليط الضوء على أشكال الرقابة التي ضمنها المشرع الجزائري عبر مختلف مراحل العملية الانتخابية، مع التركيز على الضمانات النوعية الجديدة وتقييم مدى فعاليتها في تحقيق نزاهة ومصداقية العملية الانتخابية، ومن أهم هذه الضمانات تشكيل السلطة الوطنية المستقلة للانتخابات، وفقا للتعديل الدستوري لسنة 2020، كأحد مؤسسات مراقبة العملية الانتخابية.
أما عن أهم أشكال الرقابة التي أقرها المشرع الجزائري على الانتخابات، فقد تطرقنا في هذه الدراسة إلى الرقابة الإدارية والقضائية على مستوى جميع مراحل العملية الانتخابية، والمتمثلة في العمليات التحضيرية للعملية الانتخابية من إعداد ومراجعة القوائم الانتخابية ثم الترشح في الفصل الأول، بالإضافة إلى مرحلة التصويت وما يليه. ومن المراحل اللاحقة لفرز الأصوات،
إلى التركيز على النتائج والإعلان عنها، وكذا الطعون المتعلقة بها في فصل ثان، وخلصنا في ختام هذه الدراسة إلى أن المشرع الجزائري نجح بإقرار التعديلات الجديدة التي تضمنها المرسوم 21-01 في توفير الحماية القانونية اللازمة لضمان نزاهة العملية الانتخابية وشفافيتها، على عكس ما جرى عليه العادة في الانتخابات التي جرت في ظل الأنظمة الانتخابية السابقة، وهو ما
يعد دليلا على فعالية أشكال الرقابة المختلفة التي تضمنها المرسوم 21-01. إلا أن هذه الفعالية تبقى نسبية بالنظر إلى نسب المشاركة المتدنية التي سجلت في الانتخابات، والتي تظل تشكل هاجسا حقيقيا لدى المشرع الجزائري، الذي ما زال أمامه الكثير من العمل من أجل استعادة ثقة الناخب في العملية الانتخابية والقائمين عليها، وذلك بإيجاد الحلول المناسبة لتصحيح الاختلالات التي قد تشوه العملية الانتخابية ووضع حد للتجاوزات التي قد تعيقها وتمس نزاهتها.
