Abstract
تعد الوساطة الجزائية إحدى الوسائل البديلة لحل النزاعات الجزائية التي عرفت انتشارا واسعا في العقود الأخيرة بالنظر لفوائدها والمزايا التي توفرها والمتمثلة أساسا في تخفيف العبء عن القضاء ،وتحقيق العدالة ونشر السلم الاجتماعي،والمحافظة على الروابط الاجتماعية، وحسم النزاع بين الأطراف، مما يجعلها ضمانة أساسية لحل النزاعات الجزائية ، وهذا ما جعلها تحضى باهىتمام كبير في مختلف التشريعات المقارنة. فالوساطة الجزائية نظام قانوني جديد ظهر نتيجة تغيير مفهوم الشعوب للعدالة الاجتماعية ويهدف إلى حل النزاعات الجزائية بأسلوب غير تقليدي، فمع تطور البشرية أفرز تعقيدا في العلاقات والمعاملات لكثرتها، فتطلب الأمر تفكير جديد لمواجهة ذلك التطور وإيجاد آلية يمكن من خلالها مواجهته، وقد أضحت حاجة البشرية إلى سرعة في فض خلافاتها وعدم تكدسها في المحاكم وتخفف جزء من معاناة القضاء من ازدياد الدعاوى والاستمرار في تأجيلها
Criminal mediation is an alternative means of resolving criminal disputes, which has experienced the most widespread wide in recent decades, given the advantages and benefits that it offers consisting essentially of alleviating the burden of present elimination and justice and social peace, and to maintain social ties, and to settle the dispute between the parties, which makes it an essential guarantee for resolving conflicts, it is to render a very great interest in the various reference texts.
Criminal mediation a new legal regime had to modify peoples' notion of social justice which aims to resolve criminal conflicts in a non-traditional way, with human development inspired complex relationships and transactions, p needed new thinking to deal with this evolution and the creation of a mechanism to confront, has become a human need for the rapid settlement of their disputes and the accumulation of courts and alleviate some of the suffering of the elimination of the intensification of actions and continue to wait.
