Abstract
This thesis examines high-level positions within the Algerian public administration, focusing on their legal framework, appointment procedures, and the safeguards governing the exercise of these roles. Such positions play a pivotal role in the state’s administrative structure, given their direct involvement in decision-making and the management of public services. The study analyzes the constitutional, legislative, and regulatory framework governing these positions, as well as the procedures for appointment, termination of duties, and dismissal. It further explores the rights and benefits granted to senior officials, alongside their legal obligations and liabilities—whether administrative, civil, criminal, or disciplinary. The thesis concludes that the system of high-level positions in Algeria is based on a relative balance between the administration’s discretionary power and the principle of legality; while the administration enjoys broad discretion regarding appointments and the termination of duties, such authority remains subject to legal and judicial oversight. Furthermore, these positions are characterized by their inherently temporary nature.
