Abstract
The invalidity and nullity of administrative decisions constitute a fundamental topic in administrative law, given their close connection to the legality of administrative acts. Invalidity arises when an administrative decision is tainted by a legal defect—such as a lack of competence, procedural violations, flaws in reasoning or purpose, or an abuse of power. In such cases, the decision remains in effect and continues to produce legal consequences until a court rules for its annulment within specified time limits. "Nullity," by contrast, represents a more severe form of illegality; it occurs when a decision lacks one of its essential elements—for instance, if it is issued by an authority that completely lacks competence, or if it has no legal basis whatsoever. Such a decision is considered non-existent from the moment of its issuance and produces no legal effects; consequently, it may be challenged at any time, without being subject to statutory time limits. The core distinction is that a voidable decision requires a judicial ruling for its annulment to halt its effects, whereas a null (non-existent) decision is legally void from the outset, requiring only a judicial declaration to confirm its nullity.
