Abstract
تبحث هذه الدراسة في اختصاصات المحاكم الإدارية الاستئنافية ومجلس الدولة في الجزائر في ضوء الإصلاحات الدستورية والتشريعية الأخيرة، لا سيما عقب التعديل الدستوري لعام 2020 وصدور القانون العضوي رقم 22-13. وتهدف الدراسة إلى تحليل الإطار القانوني والتنظيمي الناظم لهذه الهيئات القضائية، وتحديد اختصاصاتها النوعية والمكانية، وتسليط الضوء على دور مجلس الدولة القضائي والاستشاري. وتعتمد الدراسة المنهجين التحليلي والوصفي لتقييم مدى فعالية النصوص القانونية. وتخلص إلى أن إنشاء المحاكم الإدارية الاستئنافية يعزز مبدأ التقاضي على درجتين ويُسهم في تحسين جودة الأحكام القضائية. وفي الوقت ذاته، يظل مجلس الدولة مؤسسةً محوريةً في توحيد الاجتهاد القضائي الإداري وتطوير المنظومة القانونية، رغم وجود بعض التحديات العملية التي تتطلب مزيداً من الإصلاحات.This study examines the jurisdiction of the administrative appellate courts and the Council of State in Algeria in light of recent constitutional and legislative reforms—most notably following the 2020 constitutional amendment and the enactment of Organic Law No. 22-13. The study aims to analyze the legal and regulatory framework governing these judicial bodies, define their subject-matter and territorial jurisdiction, and highlight the judicial and advisory roles of the Council of State. Employing both analytical and descriptive methodologies, the study evaluates the effectiveness of the existing legal provisions. It concludes that the establishment of administrative appellate courts reinforces the principle of two-tiered litigation and contributes to improving the quality of judicial rulings. At the same time, the Council of State remains a pivotal institution for unifying administrative jurisprudence and developing the legal system, notwithstanding certain practical challenges that necessitate further reforms.
