Abstract
تهدف هذه المذكرة إلى دراسة الدور المحوري الذي تؤديه المحكمة الدستورية في حماية مبدأ سمو الدستور في النظام القانوني الجزائري، لا سيما بعد التعديل الدستوري لسنة 2020 الذي أدّى إلى استبدال المجلس الدستوري بمحكمة دستورية ذات صلاحيات موسعة. وقد تناولت الدراسة الأساس النظري لمبدأ السمو الدستوري وأشكال الرقابة التي تضمن احترام هذا المبدأ، ثم انتقلت لتحليل اختصاصات المحكمة الدستورية الجزائرية من خلال تصنيفها إلى اختصاصات تقليدية ومستحدثة. وتوصّلت الدراسة إلى أن المحكمة الدستورية تُعد أداة فعالة لتعزيز دولة القانون والفصل بين السلطات، غير أن فعاليتها تظل مرهونة بتوفير ضمانات الاستقلالية، وتنفيذ قراراتها على أرض الواقعThis study aims to examine the crucial role played by the Constitutional Court in safeguarding the principle of constitutional supremacy within the Algerian legal system, especially following the 2020 constitutional amendment which replaced the Constitutional Council with a more empowered Constitutional Court. The research explores the theoretical foundation of constitutional supremacy and the mechanisms that ensure its enforcement, followed by an in-depth analysis of the Court’s traditional and newly introduced powers. The study concludes that the Constitutional Court represents an effective tool for reinforcing the rule of law and the separation of powers, although its effectiveness remains dependent on its independence and the practical implementation of its decision
