    Hospital Legal Responsibility In Algerian Legislation

    The hospital plays a leading role in maintaining public health, Therefore, it was entrusted with various tasks in this field in order to take care of the health of individuals, however, this entails legal responsibility that varies between civil and administrative, the Algerian legislator worked through many texts to improve the service in general ; Especially when it comes to mistakes made by the medical and administrative staff, which sometimes lead to harming the health of the individual instead of taking care of it. And what is happening in terms of strife of responsibilities, as the citizen remains in many cases a victim of neglect, This is what drives him to resort to the courts seeking justice, here, the judge stands on the extent of the shortcomings of some legislative texts that require reconsideration and making them more appropriate and rigorous. يلعب المستشفى دورا رياديا في الحفاظ على الصّحة العمومية، ولذلك فقد أوكلت له مهام مُتنوعة في هذا النّطاق من أجل العناية بصحة الأفراد، غير أن ذلك يرتّب مسؤولية قانونية تتنوّع بين المدنية والإدارية، وعمل المشرع الجزائري من خلال العديد من النصوص على تحسين الخدمة بصفة عامة، ولاسيما عندما يتعلق الأمر بالأخطاء الصّادرة من الطاقمين الطبي والإداري والتي تؤدي أحيانا بالإضرار بصحة الفرد عِوض العناية بها، وما يحصل من تقاذف المسؤوليات، حيث يبقى المواطن في العديد من الحالات ضحية الإهمال، وهو ما يدفعه للالتجاء للقضاء طلبا لإنصافه، وهنا يقف القاضي على مدى قصور بعض النّصوص التشريعية التي تستوجب إعادة النظر فيها وجعلها أكثر ملاءمة وصرامة.

    The Role Of Algerian Legislation In Protecting The Family From Crime

    Family is the meaning of individuals meeting in affection and mercy, Its objective is to build a strong society based on cohesion and unity through the formation of the good individual, but it may not succeed in this endeavor and instead produce criminals who work to undermine the basic pillars of society, Therefore, the Algerian legislator addressed all forms of crime through many legislative texts that were aimed at prevention and deterrence. This is evidenced by allocating punitive texts for transgressing the foundations of the family, such as criminalizing family neglect and non-payment of alimony, On the other hand, the legislator tried to address some of the reasons that may contribute to the spread of crime that affects the family, by ensuring the improvement of the economic and social life of the individual through support projects, housing, free education, vocational training, Which remains insufficient and must be reviewed periodically in order to improve family conditions, in order to reduce crime that may affect the family in order to preserve the cohesion of society. الأسرة هي معنى اجتماع الأفراد على المودة والرحمة، وهدفها بناء مجتمع قوي قائم على التلاحم والوحدة من خلال تكوين الفرد الصالح، ولكنها قد لا تنجح في هذا المسعى وتنتج بدلا من ذلك مجرمين يعملون على تقويض الأسرة. الركائز الأساسية للمجتمع، ولذلك تناول المشرع الجزائري الجريمة بكافة أشكالها من خلال العديد من النصوص التشريعية التي هدفت إلى الوقاية والردع. ويتجلى ذلك من خلال تخصيص نصوص عقابية للمتجاوزين على أسس الأسرة، مثل تجريم الإهمال الأسري وعدم دفع النفقة، ومن ناحية أخرى حاول المشرع معالجة بعض الأسباب التي قد تساهم في انتشار الجريمة التي يؤثر على الأسرة، وذلك من خلال ضمان تحسين الحياة الاقتصادية والاجتماعية للفرد من خلال مشاريع الدعم، والإسكان، والتعليم المجاني، والتدريب المهني، والتي تظل غير كافية ويجب مراجعتها بشكل دوري لتحسين أوضاع الأسرة، من أجل الحد من الجريمة التي قد يؤثر على الأسرة من أجل الحفاظ على تماسك المجتمع.

    The Role Of The Judiciary In Controlling The Guardianship Of Money

    The judiciary has a central role in preserving people's money in the exercice of guardianship of money, as those who are subject to it need assistance during this phase, the guardian shall take care of the minor's money, taking into account the substantive and procedural aspects that the family affairs judge shall respect by virtue of his authorities to control and supervise the guardianship of the money, and the need to take into account the necessity and interest in issuing permission to carry out some important actions, as well as the role of family courts in the settlement of disputes on guardianship, and the monitoring of legal sanctions in the event of violation of its system, with the need to adjust the judicial work in this regard texts more flexible taking into account all the details of changing constantly. يتولى القضاء مهمة محورية في الحفاظ على أموال الأشخاص في نطاق ممارسة الولاية على المال، ذلك أن من يخضعون لها يحتاجون للمساعدة خلال هذه المرحلة، فيتولى الولي رعاية مال القاصر مُراعيا في ذلك جوانب موضوعية وإجرائية يسهر قاضي شؤون الأسرة على احترامها من خلال ما يحظى به من صلاحيات للرقابة والإشراف على ولاية المال، وضرورة مُراعاته للضرورة والمصلحة في إصدار الإذن لمباشرة بعض التصرّفات المهمّة، فضلا على دور القضاء الأسري في تسوية المنازعات المنصبّة حول الولاية، ورصد العقوبات القانونية في حال المساس بنظامها، مع ضرورة ضبط العمل القضائي في هذا الشّأن بنصوص أكثر مرونة تستجيب لجميع التفاصيل المتغيرة باستمرار.
