    الملخص : تعد الجريمة المعلوماتية أو الالكترونية من الجرائم الشائعة و المستحدثة في الفضاء السيبراني، و ظهورها مقترن بالتطور التكنولوجي الحديث و المرتبط بشبكة الانترنت ، فتطور مجتمع المعلومات صاحبه بالضرورة تطور كبير في الأعمال الإجرامية المرتكبة في ظل البيئة الالكترونية السيبرانية، وبالتالي فتح المجال للفوضى والتجاوزات غير المشروعة، خاصة أن هذا النوع من الجرائم أصبح يتجاوز المسافات والحدود الجغرافية، ورغم حداثة هذه الجرائم إلا أنها أضحت تشكل تهديد لأمن وسلامة الأفراد وحتى الدول، في وقت تعاني منه الدول العربية عموما والجزائر على وجه الخصوص قصور وعدم قدرة المنظومة القانونية التقليدية على مسايرة التطور التكنولوجي من جهة و كذا تطور الجريمة الالكترونية من جهة أخرى.
